By accessing or using PINMAKR ("the Service"), operated at pinmakr.com, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

PINMAKR is an AI-powered content creation platform that helps users:

  • Generate SEO-optimized blog posts using artificial intelligence
  • Create Pinterest pin designs with text overlays and AI-generated images
  • Perform keyword research and competitor analysis for Pinterest
  • Publish content to Pinterest (when connected via OAuth)
  • Browse and use stock media from third-party providers
  • Create image collages and video pins

3. Account Registration

  • You must create an account to use PINMAKR. Accounts are managed through Clerk authentication.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information during registration.
  • You must be at least 13 years old to use the Service.
  • One person may not maintain more than one account.
  • You are responsible for all activity that occurs under your account.

4. AI-Generated Content

4.1 Content Ownership

Content you create using PINMAKR (blog posts, pin designs, outlines) is yours. You retain ownership of the topics, ideas, and creative direction you provide. The AI-generated output is produced for your use.

4.2 Content Accuracy

AI-generated content may contain inaccuracies, errors, or outdated information. You are responsible for reviewing, editing, and fact-checking all generated content before publishing. PINMAKR does not guarantee the accuracy, completeness, or suitability of AI-generated content.

4.3 Content Responsibility

You are solely responsible for the content you publish using our platform, whether on Pinterest, WordPress, or any other destination. This includes ensuring content does not infringe on third-party rights, violate platform guidelines, or contain harmful material.

5. Acceptable Use

You agree NOT to use PINMAKR to:

  • Generate spam, misleading, or deceptive content
  • Create content that infringes on intellectual property rights
  • Produce content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Violate Pinterest's Community Guidelines or Terms of Service
  • Attempt to bypass rate limits, abuse the API, or overload the system
  • Scrape, data-mine, or reverse-engineer the Service
  • Share your account credentials with others
  • Use automated scripts or bots to access the Service (outside of our provided interfaces)
  • Generate content that promotes violence, hatred, or discrimination
  • Impersonate other individuals or brands

6. Pinterest Integration

When you connect your Pinterest account to PINMAKR:

  • You authorize us to access your Pinterest account via OAuth as permitted by Pinterest's API
  • You must comply with Pinterest's Terms of Service and Community Guidelines
  • You can revoke PINMAKR's access at any time through your Pinterest account settings
  • We are not responsible for changes Pinterest makes to their API or platform that may affect our Service

7. Stock Media Usage

Stock images and videos accessed through PINMAKR are provided by Pexels, Unsplash, and Pixabay. These images are available under their respective free licenses. You are responsible for complying with each provider's license terms, including attribution requirements where applicable.

8. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • We may perform maintenance, updates, or modifications that temporarily affect availability
  • Third-party service outages (Pinterest API, Anthropic, Ideogram, etc.) may impact PINMAKR features
  • We reserve the right to modify, suspend, or discontinue features with reasonable notice

9. Rate Limits and Fair Use

To ensure service quality for all users, PINMAKR enforces rate limits on API requests. Excessive usage that impacts other users may result in temporary throttling or account suspension. Current limits are 60 requests per minute per user.

10. Intellectual Property

The PINMAKR platform, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without written permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINMAKR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any content generated by the AI system
  • Unauthorized access to or alteration of your data
  • Actions taken on third-party platforms based on content created with PINMAKR
  • Service interruptions or data loss

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that AI-generated content will be accurate, error-free, or suitable for your specific purpose.

13. Account Termination

We may suspend or terminate your account if you violate these Terms of Use, engage in abusive behavior, or if required by law. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
